Trademark
Trademark registration is, with the advent of the internet, an ever more important tool in securing the intellectual property assets of any business. Trademarks may be registered either locally (by state), nationally or internationally. The trademark itself is created at the time it is used to identify a particular good or service. Registration on the federal level grants the owner certain rights not available to the holders of a state or common law trademark.
The process of obtaining a trademark can seem fairly straightforward. One files an application with the United States Patent and Trademark Office, submits specimen samples of the mark as used in commerce, or as the owner intends to use it in commerce, and pays the fee per class of goods or services in which the mark is used. The issue usually arises in the context of what is known as an "Office Action", in which an examiner at the USPTO will object to certain portions of the registration petition.
